FAQ: Who should be listed as the escrow agent in TREC and Texas REALTORS® contracts?The escrow agent should be the legal name of the title company handling the earnest money and closing of the transaction, not the name of a person.
For example, use "ABC Title Company” rather than “Jane Doe, escrow officer.” Putting an individual’s name in the escrow agent blank risks that the named person may not be available to accept delivery, may change roles, or may no longer work for the company during the transaction. Listing the title company helps avoid delivery and notice issues.
