Who Gets to Opt Out of Broker Responsibility Course?

If I’m a broker who’s exempt from continuing education requirements, do I still have to take the Broker Responsibility course?

No. Texas brokers who are exempt from TREC’s continuing education requirements do not have to take the Broker Responsibility course.

Brokers who are exempt from continuing education requirements are those who were informed in writing of their eligibility by TREC, gave notice between between October 1 and 30, 1991, of their wish to opt out, and paid the applicable fee.

Were all Brokers given this option or were smaller market brokers given an option not afforded to larger market brokers?

I’m with Mae Fenceroy as I did not know this option existed. We are both non-franchised, sole proprietor brokers. Are we just out of luck at this time since we missed the opt-out time?

The brokers who were in the “right place at the right time” purchased their broker’s license and were grandfathered in decades ago. As stringent as TREC is in promoting education, protecting the pubic & encouraging a strict code of ethics for the rest of us, how in the world can this continue to be honored? It is wrong.

This was a grandfather clause that was necessary to get MCE legislation passed by the Texas House. A congressman who was also a licensed broker held up the legislation unless it included language that opted out brokers licensed for 10 years or more and lived in a town/city with a population of less than 200,000 people. That fit his self-serving needs. Two things you never want to watch being made is sausage and legislation!

Any Broker who choses to opt out rather than to opt in, and stay informed to not only protect themselves, their agents and their clients, isn’t a Broker that I would want to work for or with. Just saying.

If a broker is exempt, they’re still required to take the mandatory CE though, right? No one should be practicing real estate without some sort of mandatory CE.

As I understand it, any broker that was grandfathered does not need to take any CE courses. They paid their money and that is that. Grandfathering means one only needs to comply with the rules as outlined in the wording of the grandfather clause. like it or not.

My broker, who has been licensed since 1967, never received any information regarding the eligibility to opt out of CE. I am certain as I was married to him at the time. Does he have any recourse?

I was licensed as a Broker in l971. Operated a business until 1992, was “opted out” of CE by TREC. I took a break but allways paid my dues on time and served as County Clerk for 22 years. When I retired I decided to do what I know best, i.e. real estate. I joined the local board and immediately took the “borker update”, Ethics” and the new “contract” courses. I wanted to be “updated” on what is going on now. I feel that a requirement to do the “Ethics” and others should be reserved for newer agents/brokers. I don’t… Read more »

I was offered the option. I had been licensed more than 10 years prior to 1991. (1973) I chose NOT to opt out. I felt it was in MY best interest to stay informed with classes since it was MY best way to stay informed per licensure agreement at that time. I wasn’t working real estate 100% of the time but always wanted to stay up to date. Still happy with my decision, plus occasionally see other old timers!

I was under the impression that if you sponsored agent(s) you were required to take this course, and if not, then you did not have to take it.
