These ethics complaints are in the mail

The Texas Association of REALTORS® Professional Standards Department has seen an uptick in complaints filed for farming letters and postcards that violate the Code of Ethics because they don’t disclose the firm’s name. Article 12 says you must disclose the name of your firm in a reasonable and readily apparent manner in your real estate communications.
These growing farming-letter complaints also include REALTORS® who offer to purchase consumers’ properties through an investment company separate from their real estate brokerage. In addition to violating Article 12, these letters often violate Article 4, which requires that you disclose to the seller or the seller’s agent your true position when acquiring any ownership interest in property or presenting offers for yourself, any member of your immediate family (which includes siblings), members of your firm, or any entities in which you have any ownership interest.
Keep in mind that all types of farming messages must comply with the Code of Ethics—regardless of your marketing message.
