Buying property without your spouse

Buying property without your spouse

Dear George: Can I be the sole purchaser of a home if I'm married? My wife is in jail and won't grant me a divorce.

Answer: Texas is a community-property state, which means that any property obtained during your marriage must be shared equally. You need to get a divorce before you purchase a home. Given the circumstances you describe, it's unlikely you'll be able to obtain one on your own. Hire an attorney experienced with divorces.
